voicepie User Agreement

## Preamble and Introduction
The "voicepie User Agreement" (hereinafter referred to as "this Agreement") is a legal agreement between you and Shenzhen Soundscape AI Co., Ltd., the operating company of voicepie, regarding the use of various services of the Android phone audio processing frontend service software.
In this Agreement, voicepie has highlighted in bold text those terms that may significantly affect your rights and interests (including terms that exempt voicepie from liability, limit your rights, dispute resolution terms, and judicial jurisdiction terms). Please pay special attention to these highlighted sections. Please ensure that you have carefully read, fully understood, and unreservedly accepted all terms of this Agreement before using voicepie.
The "voicepie Privacy Policy," "After-sales Policy," and other agreement specifications, rules, statements, announcements, and policies published by voicepie (hereinafter collectively referred to as "other voicepie rules") are integral parts of this Agreement. You should equally comply with these when using voicepie. Your acceptance of and agreement to this Agreement shall be deemed as your agreement to and acceptance of other voicepie rules, and your acceptance of and agreement to any other voicepie rules shall also be deemed as your acceptance of and agreement to this Agreement.
Please confirm that you possess full civil rights capacity and full civil conduct capacity, are capable of reading, agreeing to, and complying with this Agreement, and can independently bear legal responsibility for all your actions under this Agreement. If you do not possess the civil conduct capacity appropriate to your actions, you should obtain informed consent from your legal guardian. If you are a minor, please read and decide whether to agree to this Agreement accompanied by your legal guardian, and pay special attention to the terms for minors. The exercise and performance of rights and obligations under this Agreement by minors shall be deemed to have been approved by their legal guardians.
## 1. Service Description
### 1.1
voicepie provides you with services including but not limited to:
1.1.1 voicepie product website: https://www.kikago.ai (and any other websites operated by voicepie);
1.1.2 All terminal client products directly owned or operated by voicepie, including but not limited to tablets, mobile phones, etc.;
1.1.3 voicepie user personal center;
1.1.4 Servers and network storage space directly owned or operated by voicepie;
1.1.5 Various value-added services provided by voicepie;
1.1.6 Other technologies and/or services provided by voicepie, subject to what voicepie actually provides.
### 1.2
The services provided by voicepie are limited to use within the platforms described in 1.1.1 and 1.1.2 above (hereinafter referred to as "voicepie platform"). Any behavior that separates voicepie's services from the voicepie platform through malicious hacking or other illegal means does not fall under the services provided by voicepie as agreed in this Agreement. The perpetrator shall be responsible for all consequences arising therefrom, and voicepie reserves the right to pursue legal liability against the perpetrator according to law. The services provided by voicepie are for users' non-commercial use only, and users shall not use voicepie's services for commercial purposes without prior written consent and authorization from voicepie.
### 1.3
The official methods announced by voicepie for downloading clients (including but not limited to iOS, Android, and other smart platforms) and using voicepie services are the only legal ways. Any voicepie obtained by users through any other channels, routes, or methods is illegally obtained. voicepie does not recognize its effectiveness and, once discovered, voicepie has the right to immediately delete or take other actions. Users shall bear all adverse consequences resulting therefrom.
### 1.4
voicepie has the right to modify, replace, or upgrade any software related to voicepie services by advance notice to users (including but not limited to pop-up announcements, website homepage announcements, system messages). If users do not agree to or accept the modification, replacement, or upgrade of voicepie-related software, please directly refuse, stop, or cancel the use. Otherwise, it shall be deemed that users agree to and accept the modification, replacement, and upgrade of voicepie-related software, and such agreement and acceptance shall still be bound by this Agreement.
### 1.5
The term "user" in this Agreement includes all users who use voicepie products and/or services, and automatically become voicepie users upon downloading or installing voicepie products and/or using voicepie services.
## 2. Content on voicepie
### 2.1
Content on voicepie refers to any information, materials, text, software, music, audio, photos, graphics, videos, messages, links, or other materials transmitted or distributed through the services provided by voicepie, whether transmitted publicly or privately (hereinafter referred to as "Content"). Content providers and uploaders shall be fully responsible for the content they provide and upload, and shall be liable for compensation if they cause losses to voicepie. For third-party claims against voicepie regarding user-uploaded content, voicepie has the right to take necessary measures such as deletion, blocking, or disconnecting links without prior notice to the content provider or uploader.
### 2.2
For content you upload or publish on voicepie, you guarantee that you have legal copyright or corresponding authorization for it, and voicepie has the right to display, distribute, and promote such content.
### 2.3
To increase your content exposure and publishing efficiency, voicepie will additionally provide you with global display and promotion services. You agree that all content published by your account on voicepie is authorized to be synchronized by voicepie to all products operated by voicepie, including but not limited to tablets, mobile phones, television, and all client software and/or websites. Meanwhile, you allow voicepie to process the content independently or entrust third parties to do necessary processing (including but not limited to translation, compilation, adaptation, etc.) when synchronizing and displaying content. You hereby confirm and agree that voicepie has the right to independently or entrust third parties to develop and use the above content (in whole or in part) in any publicity, promotion, and/or research related to the above content, voicepie products and related services, voicepie, and/or voicepie brand in an appropriate manner. For avoidance of doubt, you understand and agree that the above content includes personal images, portraits, names, trademarks, service marks, brands, names, logos, and company marks that you own or are licensed to use and incorporate into the content. You can notify voicepie at any time to cancel this service.
### 2.4
voicepie cannot predict and reasonably control content uploaded through voicepie services. Therefore, you have foreknowledge that when using voicepie's services, you may encounter content that makes you feel uncomfortable, unsuitable, or disgusted, and you agree to waive any right of recourse against voicepie arising therefrom. However, voicepie has the right to stop transmitting any such content according to law and take corresponding measures, including but not limited to suspending your continued use of part or all of voicepie services, keeping relevant records, and reporting to relevant authorities.
## 3. Usage Rules
### 3.1
Users shall comply with the following laws and regulations when using voicepie:
3.1.1 Law of the People's Republic of China on Guarding State Secrets;
3.1.2 Copyright Law of the People's Republic of China;
3.1.3 Regulations of the People's Republic of China for Safety Protection of Computer Information Systems;
3.1.4 Regulations on Computer Software Protection;
3.1.5 Provisions on the Ecological Governance of Network Information Content;
3.1.6 Regulations on the Protection of the Right to Network Dissemination of Information;
3.1.7 Cybersecurity Law of the People's Republic of China;
3.1.8 Other laws, regulations, rules, ordinances, and other normative documents with legal effect.
### 3.2
Users are prohibited from engaging in the following behaviors:
3.2.1 Creating, uploading, copying, transmitting, or spreading content that contains anything against the basic principles established in the Constitution, endangers national security, leaks state secrets, subverts state power, undermines national unity, damages national honor and interests, incites ethnic hatred, ethnic discrimination, undermines ethnic unity, undermines national religious policy, promotes cults and feudal superstition, obscenity, pornography, gambling, violence, murder, terrorism, or instigates crimes, insults or defames others, infringes upon others' legitimate rights and interests, or other content prohibited by laws and administrative regulations, or other offensive content including but not limited to information, materials, text, software, music, photos, graphics, information, or other materials;
3.2.2 Harming minors in any way;
3.2.3 Impersonating any person or institution, or falsely stating or otherwise misleading others about your connection with any person or institution;
3.2.4 Forging headers or otherwise manipulating identifiers to disguise the origin of any content transmitted through voicepie;
3.2.5 Uploading, posting, emailing, or otherwise transmitting any content that you do not have a right to transmit (such as internal information, confidential information);
3.2.6 Uploading, posting, emailing, or otherwise transmitting any content that infringes any patent, trademark, copyright, trade secret, or other intellectual property rights of any party;
3.2.7 Uploading, posting, emailing, or otherwise transmitting any advertising, promotional materials, "junk mail," etc.;
3.2.8 Stalking or otherwise harassing others;
3.2.9 Uploading, posting, emailing, or otherwise transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment;
3.2.10 Disrupting or interfering with voicepie services or servers and networks connected to voicepie services, or disobeying any requirements, procedures, policies, or regulations of networks connected to voicepie services;
3.2.11 Without prior explicit written permission from voicepie, using any means (including but not limited to robot software, spider software, crawler software, or any automatic program, script, software) and for any reason to independently or entrust others to, assist others in obtaining platform services, content, data;

### 3.3
Users shall not issue any text carrying the "voicepie" brand, such as "cooperation with voicepie," "co-produced with voicepie," etc., through any channel or media (including but not limited to self-media). If users need to promote cooperative programs, users can only mention the program itself in the promotion and must not mention the relationship with voicepie or promote using the voicepie brand without authorization. All promotional materials from users containing "voicepie" must obtain written consent from the corresponding cooperation department of voicepie; otherwise, users shall compensate for all losses caused to voicepie.
## 4. Third-Party Links
voicepie services may provide links to other international Internet websites or resources. Unless otherwise stated, voicepie cannot control services from third-party websites, and voicepie assumes no responsibility for any loss or damage arising from users' use of or reliance on such websites or resources. We recommend that you carefully read their terms of service and privacy policies before leaving voicepie and visiting other websites or resources.
## 5. Intellectual Property Rights
5.1 Protected by international copyright conventions, the Copyright Law, Patent Law, and other intellectual property laws and regulations of the People's Republic of China, all intellectual property rights of voicepie services and the software, technology, trademarks, materials, etc. used in this service belong to and are enjoyed by voicepie. "Intellectual property rights" include any and all rights, ownership, and interests stipulated in patent law, copyright law, trademark law, anti-unfair competition law, and other laws, and any and all applications, updates, extensions, and renewals thereof.

## 6. Agreement Modifications and Notifications
6.1 voicepie has the right to modify this Agreement based on changes in national policies, technical conditions, product functions, etc., and publish the modified agreement.
6.2 Once the aforementioned content is officially published, voicepie will remind you of the updated content in appropriate ways (including but not limited to pop-ups, emails, in-site messages, website announcements, etc.) so that you can timely understand the latest version of this Agreement.
6.3 You acknowledge that the names and chapter titles of this Agreement are for convenience and reading purposes only, and because this Agreement is displayed in many places on our platform, it may take some time to complete the renaming of the entire agreement. During this period, the simultaneous existence of two names does not affect the meaning or interpretation of any terms in the main text.
6.4 The modified content will constitute an integral part of this Agreement, and you should comply with it equally. If you object to the modified agreement, please immediately stop logging in and using voicepie and related services. If you log in or continue to use voicepie and related services, you shall be deemed to have fully read, understood, and accepted the updated Agreement and are willing to be bound by the updated Agreement.
